PRODUCT AND SERVICE DESCRIPTIONS
We try to provide accurate depictions and descriptions of our products and services; however, we do not guarantee that descriptions, colors, dimensions, details or other content on our website are accurate, complete, reliable, current or error-free. If a product offered on this website is not as described, your sole remedy is to return it in unused condition (except products that are not eligible for return). Colors and other details that you see on your device may vary from the actual product. We cannot guarantee that your device will accurately display the details of our products and services.
We cannot confirm the price of an item until you have placed an order. Pricing errors may occur on our website. We reserve the right to cancel any orders containing pricing errors, with no further obligations to you, even after your receipt of an order confirmation or shipping notice from us. We may, at our discretion, contact you for instructions or cancel your order and notify you of such cancellation.
NO PURCHASES BY MINORS
The shopping cart and checkout features of this site are intended to be used by persons who have reached the age of majority in their place of residence (18 in most states).
ORDER ACCEPTANCE AND BILLING
By confirming your purchase at the end of the checkout process, you agree to accept and pay for the product(s) and service(s) ordered.
You must provide truthful and accurate billing information. Providing any untruthful or inaccurate information may result in order cancellation. Before we accept and process an order, we may also request that you provide additional information. We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified through our efforts to avoid fraud and/or account abuse.
We reserve the right to limit availability of, and/or to discontinue or terminate, any content, product, service, or other feature described or available on our website to any person, entity, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the quantities and/or cancel orders of any content, product, service, or other feature that we provide.
If your order is canceled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
We reserve the right to limit quantities available for purchase for any reason. Quantity limits may be applied per order, per person or household, or to orders that use the same credit card, billing and/or shipping address, or share any other account or order attribute. Users who attempt to circumvent quantity limitations (e.g. by using multiple email addresses or accounts to order more than a stated limit or by placing multiple orders of the same product) may have orders denied and their accounts suspended from further activity.
Promotional codes are limited in nature, void where prohibited, and may expire or be discontinued with or without notice. Promotional codes may not be copied, sold, shared with other, or applied to prior or future purchases. They are not redeemable for cash and are subject to cancellation or change at any time for any reason. Items eligible for promotional discounts may be limited to stock on hand.
RETURNS AND WARRANTIES
If you are not satisfied with an item you have purchased, you may return the item within thirty (30) days of delivery for a full refund of the purchase price, excluding shipping, handling, and other charges, unless Windmill explicitly states it will cover such charges. The item must be returned in good condition, in original or similarly appropriate packaging, and with all paperwork, parts and accessories to ensure credit. We do not take title to returned items until we receive them, which determines the thirty (30) day window from delivery. Items designated as final sale may not be returned. Please review our Product Warranty below for limits on our guarantee. If a product is returned in damaged condition, with missing parts, or otherwise has signs of abuse, we reserve the right to refuse a refund or to charge additional restocking fees, at our sole discretion.
SHIPPING AND DELIVERY
Unless otherwise explicitly stated, all shipping charges relating to your purchases through the website are included in the purchase price. Title and risk of loss for purchased items pass to you upon our delivery to the carrier. Windmill does not deliver to addresses outside the United States.
You are responsible for paying all sales, use and other taxes, including any applicable duties, relating to any of your purchases of products or services from Windmill through this website.
AIR FILTER SUBSCRIPTION
Our products contain one or more air filters that should be replaced from time to time as indicated. When making a purchase, you will have an option, but not obligation, to purchase an annual air filter subscription with automatic, recurring charges. Each annual subscription includes at least four air filters, which will be shipped approximately two to four months after initial purchase, subject to the shipping and delivery terms set forth above. BY USING THE ANNUAL SUBSCRIPTION FEATURE, YOU AUTHORIZE WINDMILL TO INITIATE RECURRING NON-REFUNDABLE PAYMENTS AS SET FORTH BELOW.
If you purchase an annual subscription, we (or our third-party payment processor) will automatically charge you, at the time of each subscription renewal, using the payment information you have provided until you cancel your subscription. Your subscription will automatically renew every twelve months, and your credit card will automatically be charged the full amount, plus any applicable taxes, and other charges at the beginning of each renewal period. YOU MUST CANCEL YOUR AIR FILTER SUBSCRIPTION AT LEAST FIFTEEN DAYS PRIOR TO THE RENEWAL DATE TO AVOID THE BILLING OF FEES FOR THE NEXT RENEWAL PERIOD.
You acknowledge that your annual air filter subscription has recurring payment features and you accept responsibility for all recurring payment obligations prior to cancellation of your subscription. Your subscription will continue until cancelled by you or until we terminate your access to or use of the services in accordance with these Terms. You can cancel your air filter subscription at any time by following the applicable instructions on the website. Cancellation will be effective at the end of the then-current renewal period. UNLESS OTHERWISE EXPLICITLY STATED, YOU WILL NOT RECEIVE A REFUND OF ANY PORTION OF THE SUBSCRIPTION FEE PAID FOR THE THEN CURRENT SHIPMENT AT THE TIME OF CANCELLATION.
Windmill Product Warranty
WHAT THIS LIMITED WARRANTY COVERS
The Air Lab, Inc. d/b/a Windmill (“Windmill”, “we”, or “us”) warrants your Windmill Room Air Conditioner (“product”) against defect in materials or workmanship under normal household use, during the warranty period set forth below. Windmill will, at its option, repair or replace the product. This limited warranty is valid only to the original retail purchaser of the product, is not assignable or transferrable to any subsequent purchaser or user, and applies only when the product is purchased through Windmill or a Windmill authorized dealer or distributor and used within the United States (“U.S.”), including U.S. Territories.
Note: Replacement products and repair parts may be new or factory-remanufactured and are warranted for the remaining portion of the original unit’s warranty period or ninety (90) days, whichever is longer. Please retain dated receipt and delivery confirmation as evidence of the date of purchase for proof of warranty (you’ll be required to submit a copy to Windmill).
One (1) year from the date of purchase: Any internal / functional parts.
HOW SERVICE IS HANDLED
In-home service may be provided during the warranty period subject to availability within the United States. In-home service will not be available in all areas. To receive in-home service, the product must be unobstructed and accessible to service personnel. If during in-home service repair cannot be completed, it may be necessary to remove, repair and return the product. If in-home service is unavailable, Windmill may elect, at its own option, to provide a new unit and request a return of the existing unit.
WHAT THIS LIMITED WARRANTY DOES NOT COVER
1. Service trips to deliver, pick up, or install the product or for instruction on product use.
2. Replacing house fuses or resetting of circuit breakers, correction of house wiring or plumbing, or correction of product installation.
3. Damage or failure caused by leaky / broken / frozen water pipes, restricted drain lines, inadequate or interrupted water supply or inadequate supply of air.
4. Damage or failure caused by accidents, pests and vermin, lightning, wind, fire, floods or acts of God.
5. Damage or failure resulting from misuse, abuse, improper installation, repair or maintenance. Improper repair includes use of parts not approved or specified by Windmill.
6. Damage or failure caused by unauthorized modification or alteration to the product.
7. Damage or failure caused by incorrect electrical current, voltage, or plumbing codes.
8. Damage or failure caused by improper filter management or replacement.
9. Cosmetic damage, including scratches, dents, chips or other damage to the finish of the product, unless such damage results from defects in materials or workmanship and is reported to Windmill within seven (7) calendar days from the date of delivery.
10. Damage or missing items to any display, open box, discounted, or refurbished product.
11. Product where the original factory serial numbers have been removed, defaced or changed in any way.
12. Repairs when product is used in other than normal and usual household use (e.g. rental, commercial use, offices, or recreational facilities) or contrary to the instructions outlined in the owner’s guide.
13. The removal and reinstallation of the Product if it is installed in an inaccessible location.
THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING AND WITHOUT LIMITATION TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT ANY IMPLIED WARRANTY IS REQUIRED BY LAW, THIS WARRANTY IS LIMITED IN DURATION TO THE TERM PERIOD EXPRESSED ABOVE. REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE EXCLUSIVE REMEDY FOR THE CUSTOMER. NEITHER THE MANUFACTURER NOR ITS U.S. DISTRIBUTORS SHALL BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY NATURE, INCLUDING AND WITHOUT LIMITATION TO, LOST REVENUES OR PROFITS, OR ANY OTHER DAMAGE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
